Terms of Service

1. What this agreement is
These terms are a binding agreement between you and Badminton Village Limited (“we”, “us”), a New Zealand company operating the website at badmintonvillage.co.nz and any related applications (“the platform”). By signing up, booking a session, listing a club or coaching service, or otherwise using the platform, you agree to these terms.
If you don't agree, don't use the platform.
2. What we do
Badminton Village is a marketplace and community platform for badminton in New Zealand. We connect:
- Players looking for clubs, sessions, coaching, and community.
- Clubs running sessions and managing memberships.
- Coaches and training providers taking bookings.
We are not the supplier of badminton sessions or coaching. Clubs and coaches are independent operators. When you book a session, your contract for that session is with the club or coach directly. We facilitate the introduction, the payment flow, and the tools that make it work.
3. Your account
You must be at least 13 years old to create an account. Users under 18 must have a parent or guardian agree to these terms on their behalf.
You're responsible for everything done through your account. Don't share your password. Tell us immediately at security@badmintonvillage.co.nz if you think someone else has accessed it.
We may suspend or close accounts that violate these terms or expose the platform to risk (e.g. fraud, harassment, payment disputes).
4. Bookings, payments and refunds
Detailed rules are in our Refunds & Cancellations Policy. The headline points:
- When you pay for a session online, the club / coach receives the session fee. We retain a small platform fee (currently $1.50 + GST per booking) plus a credit-card surcharge that recovers the processing cost. The breakdown is shown to you at checkout.
- Cancellation rules are set by the organiser of each session and shown on the session page. If you cancel inside their cutoff, the forfeit % they set will apply.
- If the organiser cancels the session, you receive a full refund automatically.
- Credit packs (prepaid wallet credit) are refundable in full within 14 days of purchase if no credit has been used. After any redemption, credit packs are non-refundable.
5. Featured placements and paid promotions
Clubs and coaches can pay for “Featured” placement in homepage carousels and other surfaces. We disclose these as “Featured” or “Sponsored” on every appearance, as required by the Fair Trading Act 1986. Featured ranking does not imply quality endorsement by us. 6. Content you post
You keep ownership of everything you post (reviews, profile, photos, messages). You grant us a worldwide, royalty-free, non-exclusive licence to host, display, and translate that content for the purpose of operating and promoting the platform. The licence ends when you delete the content (with reasonable lag for backups).
Don't post anything you don't have the right to. Don't post things that breach our Acceptable Use Policy.
7. The platform “as is”
We work hard to keep things running, but we can't guarantee the platform will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, we provide the platform “as is” and disclaim all warranties not expressly given.
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those rights apply to you as a consumer in New Zealand.
8. Limitation of liability
We are not liable to you for:
- Acts or omissions of clubs, coaches, or other users. Disputes about a session, coaching, equipment, conduct, or facilities are between you and the relevant party.
- Loss of profit, loss of opportunity, loss of data, or any indirect/consequential loss, however caused.
- Personal injury or property damage arising from sports activity (see Sports & Injury Disclaimer and your ACC cover in New Zealand).
Where liability cannot be excluded, our aggregate liability to you in any 12-month period is limited to the greater of (a) the platform fees you paid us in that period, or (b) NZ$200.
9. Termination
You can close your account anytime via your profile settings. We may terminate your access if you breach these terms, abuse the platform, or create undue legal or reputational risk for us.
Sections that should reasonably survive termination (content licence, liability, dispute resolution, refunds for valid claims) do so.
10. Changes to these terms
We'll update these terms occasionally. Material changes get an email notice and a banner on the site at least 14 days before they take effect. Continued use after the effective date is your acceptance.
11. Dispute resolution
If you have a complaint, please email disputes@badmintonvillage.co.nz first. We aim to respond within 5 working days.
If we can't resolve it together, you can take it to the Disputes Tribunal or the courts. These terms are governed by New Zealand law. You and we both submit to the non-exclusive jurisdiction of the New Zealand courts.
